Terms of Use (EULA)

1. Acceptance of Terms

By downloading, accessing, or using Vibe Twin ("the App", "we", "our", "us"), you agree to be bound by this End User License Agreement ("EULA") and Terms of Use. This is a legally binding agreement between you and Vibe Twin. If you do not agree, do not download, install, or use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Vibe Twin on a compatible device that you own or control, solely for your personal, non-commercial use. This license is governed by the Apple Media Services Terms and Conditions for users who acquire the App from the Apple App Store, and by Google Play Terms of Service for users who acquire it from Google Play.

3. Eligibility

You must be at least 13 years of age to use Vibe Twin. By using the App, you represent and warrant that you meet this age requirement. Users between 13 and 18 should have parental or legal guardian consent. The App is not directed to children under 13 and we do not knowingly collect personal data from them.

4. Account Registration & Responsibilities

To use the social features of Vibe Twin you must connect a Spotify or Last.fm account. You are responsible for:
  • Providing accurate, current, and complete information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Not impersonating others or creating fake profiles

5. Subscription Terms (Vibe Twin Premium)

Vibe Twin offers an optional auto-renewable subscription called Vibe Twin Premium, sold through the Apple App Store (StoreKit / In-App Purchase). Current plans and pricing:
  • Premium Monthly — $2.99 USD per month, billed every 1 month
  • Premium Yearly — $17.99 USD per year, billed every 12 months (approximately $1.50/month)

Auto-renewal. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing & cancelling. You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID account settings: Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period; you will continue to have access to premium features until that date.

Refunds. No refunds are offered for partial subscription periods. Refund requests are handled by Apple in accordance with the Apple Media Services Terms of Service.

Free trials and promotions. If a free trial is offered, it is available to new subscribers only and converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends.

Premium features include: unlimited swipes, unlimited Music Twin discovery, unlimited Vibe Doctor mood recommendations, unlimited Vibe Star searches, unlimited Vibe Sessions, unlimited Music DNA comparisons, and the ability to see who liked you. Specific features may be added, modified, or removed over time; material changes will be communicated in advance.

6. Acceptable Use

You agree NOT to:
  • Use the App for any unlawful, fraudulent, or unauthorized purpose
  • Harass, bully, threaten, defame, stalk, or intimidate other users
  • Post, send, or share offensive, obscene, hateful, sexually explicit, violent, or otherwise objectionable content
  • Create fake, misleading, or impersonating profiles
  • Send spam, unsolicited promotional content, or chain messages
  • Attempt to hack, exploit, decompile, disassemble, or reverse-engineer the App
  • Use automated bots, scripts, scrapers, or any non-human means to interact with the App
  • Collect, harvest, or extract other users' personal data
  • Circumvent rate limits, security measures, or content moderation systems
  • Transmit viruses, malware, or any code intended to disrupt the App
  • Use the App in any way that violates the rights of third parties, including intellectual property rights

Zero tolerance for objectionable content and abusive users. We do not tolerate objectionable content or abusive behavior of any kind. Reports are reviewed and we take action — including content removal and account termination — within 24 hours of a verified report.

7. User Content & License to Us

You retain all ownership rights in the content you create within the App (messages, profile information, photos, bio text, vibe-session participation). By posting or transmitting content through Vibe Twin, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and transmit your content solely for the purpose of operating and providing the App and its features to you and other users you interact with. You are solely responsible for your content and must have all necessary rights to share it.

8. Reporting, Blocking & Moderation

Vibe Twin provides tools to report and block other users from within the App:
  • Report — flag a user or message for review by our moderation team.
  • Block — instantly remove a user from your matches and prevent any further interaction; the user is also reported to us so we can investigate.
  • Unmatch — remove a match and delete the associated conversation.

We review every report and take appropriate action, which may include warning the offender, removing content, suspending or permanently terminating accounts. We aim to act on credible reports within 24 hours.

9. Music Data & Third-Party Services

Vibe Twin accesses your music listening data through the Spotify Web API and/or the Last.fm API, depending on which service you connect. We use this data solely for the matching, recommendation, and social features described in our Privacy Policy. We never modify your Spotify or Last.fm accounts, never post on your behalf, and you can disconnect either service at any time from the App settings. Your use of Spotify and Last.fm is governed by their respective terms of service and privacy policies.

10. AI Features Disclaimer

The App uses third-party AI services (including Google Gemini) to power features such as Vibe Doctor mood-based recommendations, Music DNA comparisons, and AI genre classification. AI-generated content may contain errors, inaccuracies, or unexpected results and should be treated as suggestions, not professional advice. We make no warranty regarding the accuracy, reliability, or suitability of AI-generated output and accept no liability for any reliance you place on it.

11. Intellectual Property

The Vibe Twin name, logo, design, source code, algorithms, and all related materials are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the App without our prior written permission.

12. Termination

We may suspend or permanently terminate your account, with or without notice, if:
  • You violate these Terms or the Acceptable Use policy
  • You engage in fraudulent activity or abuse
  • Your account has been inactive for an extended period
  • We are required to do so by law
  • We discontinue the App

You may delete your account at any time through the App settings. Deletion permanently removes your profile and associated personal data, subject to limited retention for legal and operational purposes as described in our Privacy Policy.

13. Disclaimers

  • The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement.
  • We do not guarantee the accuracy, completeness, or quality of matches, recommendations, or any other algorithmically generated output.
  • We are not responsible for the conduct of other users, whether online or offline, or for any interactions you have outside the App.
  • Service availability may be interrupted for maintenance, upgrades, or reasons beyond our control.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Vibe Twin, its affiliates, officers, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the App. Our total aggregate liability for any claim arising out of or relating to the App shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) USD $50.

15. Indemnification

You agree to defend, indemnify, and hold harmless Vibe Twin and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (i) your use of the App; (ii) your violation of these Terms; (iii) your violation of any third-party right, including any intellectual property or privacy right; or (iv) any content you post or share through the App.

16. Dispute Resolution

Before filing a formal claim, you agree to first attempt to resolve any dispute informally by contacting us at rtimetasks@gmail.com. We will work with you in good faith to resolve the issue within thirty (30) days.

If we cannot resolve the dispute informally, it shall be settled in accordance with the laws of the Republic of Bulgaria and the European Union, and shall be subject to the exclusive jurisdiction of the courts of Sofia, Bulgaria. To the extent permitted by law, you waive any right to participate in a class action or class-wide arbitration.

17. Apple App Store Additional Terms

If you obtained the App from the Apple App Store, the following additional terms apply:
  • This EULA is concluded between you and Vibe Twin only, not with Apple. Apple is not responsible for the App or its content.
  • The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of it.
  • Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

18. Changes to These Terms

We may update these Terms from time to time. We will post the updated version in the App and on this page with a new "Last updated" date. For material changes, we will provide additional notice (such as an in-app message or email). Your continued use of the App after the effective date of the updated Terms constitutes acceptance.
